Session Fees

$50 deposit required to reserve session date. Remaining balance is due the date of the session. If payment is not made on the agreed upon date, a $50 late fee will be applied. No content will be delivered until full payment is made.

Deposit

Session is not confirmed until the deposit is paid and contract is signed digitally. If Client needs to reschedule, the Client agrees to give contact prior to 24 hours notice of said reserved session date, otherwise the Client forfeits transfer of deposit for a new session date. Deposit is nonrefundable.

Weather

If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.

Gallery Uploads
The digital images will be ready within 3 weeks of session date unless otherwise agreed upon.

Session Punctuality

Please make every effort to be at your session on time. Please know that if you are late, it will be docked from your time allotted. If you fail to show up during your scheduled appointment the Client understands the deposit is forfeited. Session starts and ends at the agreed upon time regardless of the Client's arrival time. Tardiness of your session will not delay your session. The session will remain within the scheduled time frame.

Artistic Rights

The Photographer retains the right of discretion in selecting the photographic materials released to the Client unless otherwise agreed upon.

Liability

Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release Photographer from any claims against their person or their business.

Copyright and Reproductions

The Photographer owns the copyright for all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website and/or studio.

Client Usage

Images received from BN Photo and Video may not be altered from their original version in any way. This includes but is not limited to: turning color images to black and white, adding text, cropping, or color accenting. Photographs are hand edited to Photographer's standards and reflect on the artist.

Client(s) may print and/or post the photos and/or videos online and agree not to digitally manipulate the Work. Any use of the photos and/or videos in featured publications or websites must be accompanied by a credit of BN Photo and Video. (ie: “Photo/Video By: BN Photo and Video”) Likewise, any use of the photos and/or videos on social media platforms must be accompanied by the proper tagging system on each respective platform (ie: tagging the BN Photo and Video account if posting on Instagram)

Communication 
The Client agrees to positive cooperation and communication for the best possible result within the definition of this assignment. BN Photo and Video is not responsible for key individuals' failure to be present or to fully cooperate during photography sessions, neither for missed images due to lack of cooperation.

Retouching

Standard retouching includes light blemishes. Files are automatically lightly retouched for no added fee. Photographer will not edit for size, hair color, spray tans, clothing, stains, tan lines, etc. Photographer will only do standard retouching.

Failure to Perform

If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return any money paid to the client and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, all payments will be refunded and the Photographer shall have no further liability.

Model Release

I grant permission for BN Photo and Video, to take and use; printed or electronic publications, websites, or other electronic communications, media, advertising, promotion, marketing, and packaging for any products or service. I further agree that my name and identity may be revealed in text or commentary in connection with the image(s). I authorize the use of the images without compensation to me. All negatives, prints, digital reproductions shall be the property of BN Photo and Video. Model Release approval must be made by a parent/guardian if any photo session participants are less than 18 years of age. I agree that this release is irrevocable, worldwide and perpetual. I have read and fully understand this information in this model release. I agree this model release is for everyone involved in the session.

Client(s) agree(s) to only complete and submit this digital form if they have read and agreed to the terms of service in this contract and they believe all information is deemed correct to the best of their knowledge.
